MPAA Lines Up With Porn Studio in Steamy Copyright Dispute

The MPAA has gotten involved in a dispute over a website that allowed users to upload embedded links to porn videos.
The case is Flava Works, Inc. v. Gunter, pending before the 7th Circuit Court of Appeals. It has suddenly become one of the hottest cases on the docket, thanks to a ruling last year by a federal judge, an appeal, and submitted amicus briefs by the MPAA, Google, Facebook and others.
In 2010, MyVidster, a social video bookmarking site, was sued by Flava Works, which considers itself to be the best provider of gay erotica featuring black and latino men.
The plaintiff alleged that its copyrighted works had been infringed, and in a ruling last July that granted a preliminary injunction, Illinois federal judge John Grady ruled that MyVidster and its operator, Marques Rondale Gunter, couldn’t avail themselves of safe harbors under the Digital Millennium Copyright Act because the site hadn’t acted beyond minimum requirements.

The website "GayStash: Collect and share your gay videos and pictures" looks nice at first glance! I'm bothered by the truth that there is no point of contact with the site administrator. It is not known what will happen to the uploaded videos. The settings are very poor and for now it is not possible to repair the data...jboop said:

The only website that I found is similar is gaystash.com, which lets you collect bookmarks like myvidster did. There isn't that much great content on there yet, but at least I can save content from other sites in one spot.Click to expand...

Online copyright cases have been coming at such a furious pace that I haven’t had a chance to keep up. This blog publish wraps up the last 4 months of decisions.
Arista Records v. Myxer, Inc., 2:08-cv-03935-GAF-JC (C.D. Cal. April 1, 2011)
Myxer allows users to upload sound files and create downloadable ringtones up to 40 seconds distant. The plaintiffs claimed 90+% of the ringtones were at least 34 seconds; but Myxer claims its average length is 25 seconds and that this is shorter than Audible Magic can reliably filter. Myxer claims to be a tool for independent artists to easily get their music into the mobile environment, but of course users can upload third party copyrighted material. UMG objects to the ringtones at Myxer because the downloadable ringtones disrupt its paid-download ringtones business. For reasons that aren’t explained, UMG apparently never sent a proper 512 takedown observe, and Myxer treated the complaint as a takedown notice.

A major website used by many to access pornography has abruptly closed down.
Marques Gunter, the CEO and founder of MyVidster, announced that the popular social video sharing and bookmarking site had been shut down over the weekend.
In a bizarre message on the website's homepage, Gunter wrote, 'I recently decided to cover MyVidster down. I contain been running this site for over 18 years.'
He continued, 'I have scarficed (sic) my life for MyV and I almost died last year doing so.
'Due to the endless attacks, please communte (sic) with us on our X account to insure that we have received it. Thank you, Marques.'
He then added, 'PS, I know of the gammercal (sic) errors, but I really do not donate a f**k.'
MyVidster was used to share and bookmark videos from various websites.
Although it was not officially a porn site, it was used by many to save and view pornography, much in the same way that Tumblr previously was.
