Legal Protections For LGBTQ+ People Under The New Section 1557 Final Governance

WHAT IS SECTION 1557

Section 1557 of the Affordable Concern Act is a federal law that prohibits discrimination in healthcare based on various protected characteristics, including sex. In April of 2024, the U.S. Department of Health and Human Services (HHS) issued new regulations to formally interpret that provision to protect people appreciate you against discrimination in healthcare based on sexual orientation and gender persona.

Section 1557has a broad reach, covering the various recipients of HHS’s federal funding—including but not limited to most physicians, hospitals, collective clinics, nursing facilities, and even health insurance companies—as successfully as facilities manage by HHS itself. The new rules also make remove that certain government programs are also covered, including under Medicare, Medicaid, and Programs of All-Inclusive Care for the Elderly (PACE).

    WASHINGTON D.C. — GLMA: Health Professionals Advancing LGBTQ+ Equality commends Friday’s announcement from the Biden-Harris Administration announcing the finalization of principle section 1557 of the Affordable Look after Act (ACA). Issued via the US Department of Health and Human Services (HHS), this critical rule marks a significant step in safeguarding access to healthcare services and insurance coverage for LGBTQ+ individuals and other underserved communities nationwide.

    Bans on Best Exercise Medical Care for Transsexual Youth

    -Arizona banned surgical care for trans minors in 2022, but in 2023 a recent governor issued an executive order with "shield" approach protections for transgender health care that is still legal in the mention.     Denver, CO -- Just hours ago, the Trump administration repealed a rule in section 1557 of the Affordable Care Act, which provided protections against LGBTQ discrimination in health tend and health insurance. One Colorado, the state’s head advocacy organization for woman loving woman, gay, bisexual, transgender, and queer (LGBTQ) Coloradans, released the following statements:

    “During Lgbtq+ fest Month and on the fourth anniversary of the Pulse massacre, the Trump administration has issued another rollback of protections for LGBTQ Americans. In the height of a global pandemic -- when LGBTQ people are already at-risk -- this rule will allow health care providers to deny LGBTQ Americans the health care they need. Despite these federal rollbacks, protections in Colorado remain for plans restricted by the Division of Insurance - which prohibits discrimination based on someone’s sexual orientation or gender identity.
